Short answer

What can you claim when a photograph is used without a licence?

The licence fee you would have charged for that exact use — territory, media, duration and prominence — plus a going-forward licence or takedown. Removed credits and continued use after notice push the figure higher.

Image rights sit in an awkward gap. The UK has no standalone right in a person’s image, so protection comes from copyright in the photograph, contract terms in the shoot agreement, data protection where the subject is identifiable, and passing off where a brand or personality is implied. Most disputes are lost or won on which of those routes you pick first.

Overview

Who owns the photograph, and why it decides everything

In the UK the photographer is the first owner of copyright unless the shoot was done as an employee, or the contract assigned it. Commissioning and paying for images does not transfer copyright on its own. Before any demand goes out we establish the ownership chain, because a claim brought by the wrong party invites a cheap defence.

Employment, commission and freelance status at the point of capture
Written assignments, and whether they were signed and in scope
Implied licences created by conduct, invoices or supply of files
Third-party rights inside the frame: artwork, logos, buildings, people
How It Works

Unlicensed use: the commercial route before the legal one

Most unauthorised commercial use resolves through an invoice-and-licence route rather than court. The objective is the fee the user should have paid, plus a licence going forward — recovered quickly, without the cost of a claim.

1

Evidence first

Dated captures of the use, the original file with metadata, prior licensing at comparable rates, and the chain of ownership. Evidence assembled properly is what makes a demand land at the first attempt.

2

Value the use, do not guess it

Territory, media, duration and prominence set the licence value. A homepage banner run for two years is not a social post. Pricing the use against your own rate card and industry comparables is what turns a complaint into a recoverable number.

3

Escalate in the right order

Platform takedown, direct commercial demand, formal letter through a regulated firm, then proceedings. Skipping straight to the last step raises cost and lowers settlement rates.

Our Approach

Licensing terms that prevent the dispute

Most of the matters we see were avoidable in the paperwork. We review and rewrite the commercial terms so the next twelve months of usage are covered.

Scope drafted by media, territory and term rather than “marketing use”
Credit, moral rights and alteration provisions stated explicitly
Sub-licensing, agency and reseller permissions ring-fenced
Release wording for identifiable people and private property
Rate card tiers that make overuse an upsell instead of a fight
AI and machine-learning use addressed rather than left silent
What To Expect

Brands and agencies: clearing images before publication

The other side of the same matter. We audit what an image library is actually cleared for, close the gaps in supplier terms, and give marketing teams a workable clearance process so a campaign does not create a claim.

Library and asset-management audit against licence records
Supplier, freelancer and agency contract alignment
Clearance checklists for shoots, UGC and influencer content
Response playbook for incoming rights demands
Working With Us

How we work

1

1. Scoping call

Thirty minutes on the facts, the commercial objective and the realistic routes. You leave with an indicative cost and a recommended sequence.

2

2. Position review

Ownership, licence position, evidence and quantum written up as a short commercial assessment rather than a legal opinion.

3

3. Execution

We run the commercial recovery or the documentation work, and bring in a regulated firm where representation or proceedings are required.
